The Department of Justice’s Antitrust Division has taken an aggressive stance in criminal enforcement in labor markets. To this end, the Antitrust Division has brought several significant criminal cases against aerospace executives, major healthcare and pharmaceutical companies and executives.
DOJ has promised more criminal cases. Global companies face significant risks, and human resource professionals have to redouble their efforts to ensure compliance with criminal antitrust law.
In order to mitigate this significant risk, Global companies have to build effective antitrust compliance programs that address the specific risks created by recruiting and employee hiring procedures. Human Resource professionals and senior executives are on DOJ’s target list and compliance should be be a high priority for talent management.
