The Justice Department, the Department of Commerce’s Bureau of Industry and Security (“BIS”) and the State Department’s Directorate of Defense Trade Controls (“DDTC”) have begun an aggressive civil and criminal enforcement program. DOJ’s National Security Division has announced its intention to prosecute criminal export controls cases.
From the administrative/civil side, BIS and DDTC have each announced large civil settlements with Seagate and Boeing, respectively. In this environment, companies have to elevate their trade compliance programs to address specific trade regulations for dual use and military articles.
Alex Cotoia, Regulatory Manager, and Michael Volkov will review important elements of trade compliance for companies involved in foreign exports and imports, and describe practical steps companies need to take to mitigate the ever-increasing trade compliance risks.
