Risk and Compliance: 2025 has been a tumultuous year and the impact on risk and compliance programs has been significant. National security enforcement issues — sanctions and export compliance risks have increased dramatically, while “traditional” anti-corruption FCPA issues have diminished. Despite these changes in government enforcement priorities, corporate stakeholders continue to demand ethical conduct and values, along with aggressive responses to corporate misconduct, especially conflict of interest issues.
Sanctions and Export Controls: The new era of trade enforcement hit with a bang this year — new practices and trends have been established. As a result 2026 looks like a big year for enforcement and compliance. Leading the way, DOJ has assembled together the regulatory agencies — OFAC, BIS, DDTC, and CBP — to bring together a formidable enforcement team focused on sanctions, export controls, tariff evasion and other potential false claims issues. Companies face increased risks in the export and import arenas, raising a new panoply of risks. DOJ sent an important enforcement message, linking together traditional enforcement tools to secure comprehensive settlements.
