In September and November 2024, the Department of Justice issued revised versions of its Evaluation of Corporate Compliance Program (“ECCP”) and its Evaluation of Corporate Compliance Programs in Antitrust Criminal Investigations (“ECCP-Antitrust”), respectively. DOJ’s guidance continues to break new ground and reaffirm important compliance priorities, especially in areas involving technology and artificial intelligence.
Companies need to review these updated guidance documents — the ECCP and ECCP-Antitrust contain important new requirements that are intended to increase compliance implementation of data analytics and ensure proper coordination activities among the various functions in the corprate governance structure.
